Why we advertise Development Applications

The City advertises development applications for public comment in certain situations:

  • When the City deems that the development may impact the amenity of surrounding property owners or occupiers;
  • When, as part of an assessment process, the City deems the non-compliance element/s of the proposal is of a minor nature; and
  • When there is a statutory requirement to do so.

Depending on the project, we may advertise development applications in one or more of the following ways:

  • Letters to nearby land owners or occupiers;
  • On-site signage;
  • On our Your Say Gosnells webpages;
  • Advertising in local newspapers.

For standard applications, the State Planning Regulations require a 14 day comment period.

For complex applications, the State Planning Regulations require a 28 day comment period. In some circumstances, a longer time frame may be agreed with the applicant.

    The City of Gosnells seeks your feedback on the proposed Patio at 62 (Lot 5) Austin Avenue, Kenwick.

    The application includes:

    A 49.5m² patio that is located along the north eastern boundary of the property. The proposal does not comply with the requirements of the Residential Design Codes (R-Codes), as: 

    • The patio has a length of 20.9m and includes a 0.5m setback to the boundary (including posts with a nil setback), in lieu of the 1.5m required setback. 

    The application has been advertised as the setback of the patio does not comply with the ‘Deemed-to-Comply” requirements of the R-Codes.

    The application includes:

    The City of Gosnells seeks your feedback on the proposed Agriculture - Intensive (Aquaculture) at 80 (Lot 402) Dale Place, Orange Grove.

    The application includes:

    • Construction of a single storey Aquaculture premises 
    • Aquaculture will involve the growing / farming of goldfish of which will be sold by wholesale to pet shop. The applicant expects approximately 500 goldfish to be sold per month. 
    • Two staff members and five car bays are provided. 
    • The applicant has advised that wastewater will be gravity fed into leach drains. Spillage of pond water will be washed down through drains located within the shed and bore water used to pump the aquifer.

    Variations sought

    1. Primary Street Setback - (Nicholson Road) - Pursuant to Local Planning Scheme No.6, Table No. 2B - Industrial zones setbacks and landscaping requirements the minimum front setback is 15m.  A portion of the existing building is setback 10.5m, proposed are two roof cover portions at 10.5m setback and a roof covered seating area with Nil setback.
    2. Landscaping - pursuant to Local Planning Scheme No.6, Table No.2B, the minimum landscaping width abutting all streets is 3m, proposed is Nil.
    3. Car parking - pursuant to Local Planning Scheme No.6, Table 3A - Parking Standards, a net increase in beer garden area of 61.5sqm requires an additional 16 car bays, there are 89 car bays existing whereby 85 car bays are being proposed.

    The City of Gosnells seeks your feedback on the proposed Request for Removal of Restriction to Operating Hours at 95 (Lot 8) Forest Lakes Drive, Thornlie.

    On 13 March 2012 Council resolved to approve (Resolution 94) a Fast Food Outlet at the subject site, subject to 13 conditions. One of the conditions of approval restricts the hours of operation as follows:

    “Hours of trading within the restaurant are to be restricted to:

    ·      Sunday to Friday 6am to 11pm

    ·      Saturday 6am to 2am Sunday

    With the drive-thru permitted to operate 24 hours a day.”

    The application proposes to amend the development approval to remove the condition restricting the hours of operation, as described above. The proposal is seeking to allow the Fast Food Outlet (McDonalds) to operate 24 hours per day, seven days per week, for both the restaurant and drive through facility. Currently, only the drive through facility operates 24 hours per day, seven days per week.

    The application involves the following:

    • The construction of a toilet block, and the retention of an existing shed, office and four shipping containers. 
    • The installation of a 4,500m² hardstand area reduced from the previous 9,200m2 proposed. 
    • The provision of 14 car parking bays, reduced from the previous 36 proposed. 
    • The provision of eight truck parking bays, reduced from the previous 21 proposed. 
    • The provision of a 3m landscaping buffer along a portion of the south-western side boundary to provide visual screening. 
    • The driver education training will involve the use of two medium rigid trucks, nine heavy rigid trucks, five prime movers, and two utility vehicles. 
    • The business will accommodate six staff members (reduced from 11 previously) and a maximum of 12 students at any one time (increased from eight students previously). 
    • The business will operate from 6am to 5pm, Monday to Saturday and from 8am to 5pm on Sundays.
    • No truck movements on Sundays.
    • The Training Centre will provide the following services: 
      • Driver training for various vehicle licence classes (eg, Heavy Rigid, Heavy Combination, Multi-Combination, etc) and testing in association with the Department of Transport. 
      • Driver safety courses.
      • Transport Logistics Training Course (securing cargo loads). 
    • All vehicle maintenance and repairs will be conducted off-site.

    • Demolition of an existing primary dwelling to be replaced by a 295m2 building comprising the Use Not Listed (Wellness Centre). The existing ancillary dwelling will be retained and used as a Caretakers Dwelling; 
    • The Use Not Listed (Wellness Centre) will consist of eight consulting and treatment rooms, with the treatments based upon Ayurveda practices where consultation on diet, lifestyle management, restorative health and wellbeing through massage will be undertaken. The Use Not Listed (Wellness Centre) is intended to employee up to five staff and operate between 7am - 7pm, Monday to Friday, 7am - 5pm Saturday and Sunday by appointment only; and 
    • There are 16 carparking bays proposed onsite for employee and patient use, with access and entry to the site is provided from Rimmer Lane.

    The City of Gosnells seeks your feedback on the proposed Place of Worship and Single House at 180 (Lot 3) Maddington Road, Maddington.

    The application includes:

    • The construction of a 169m2 Place of Worship, car park, driveway, canteen, toilets, bin area, effluent disposal area and a single house. The canteen and toilets are incidental to the Place of Worship and will not operate independently. A Priest will occupy the Single House.
    • The use of the Place of Worship as follows:
      • For prayers and food celebrations on a daily basis.
      • For religious classes and festivals to occur 10 days per year and will only occur between 15 to 25 January each year.
      • A capacity of 20-25 people, plus two Priests and one canteen staff on site at any one time for the majority of religious activities.  The capacity is proposed to be extended to 30-35 people during the 10 festival days.
      • To open daily from 6am to noon and then 5.30pm to 9pm, with canteen and festival opening hours to be the same.
      • No external amplified music.

      • The retention and renovation of the existing tavern to accommodate the Place of Worship, toilets, crèche, store room and an admin room.
      • The construction of a learning area that comprises three separate spaces. 
      • The construction of a multi-purpose hall that includes a play space with admin and storage room and male and female toilets, 
      • The construction of a café space accommodating seating, food preparation areas, storage areas, a service area and two toilets.
      • The construction of a retail shop next to the café in a stand-alone building. The shop includes two store rooms, toilets, a kitchen, loading area and retail floor space. 
      • The reconfiguration of existing parking on site to accommodate 78 parking bays, including two disabled parking bays
      • Vehicle access to the site will be through existing crossovers on Sheoak Road and Radiata Street with existing trees vegetation along Sheoak and Radiated proposed to be retained.

    • An internal floor space area of 480.2m² which consists of staff amenities and five child care rooms; 
    • A maximum of 82 children will be cared for. Their age breakdown is as follows: 
      • 12 children less than 12 months of age;
      • 15 children between the ages of 1 - 2; 
      • 15 children between the ages of 2 - 3; and
      • 40 children between the ages of 3 – 5.
    • Five outdoor play spaces surrounding the main building, which total 588m²;
    • A maximum of 13 full-time staff employed on site;
    • The hours of operation will be from 6:30am to 6:30pm, Monday to Friday;
    • 19 car parking bays, including one Universally Accessible bay, five drop-off and pick-up bays, and 13 bays exclusive for staff use;
    • Vehicle access is via a new 5.8m wide crossover to Ravenhill Road; 
    • The development will provide a 2.1m high colorbond fence abutting the boundaries of 5 Ravenhill Road and 4 Griffith Way, and a 1.8m high ‘open character’ fence to 2 Camberly Street; and 
    • The provision for six external signs and one internal sign.

    The City of Gosnells seeks your feedback on the proposed Industry - Noxious at 33 (Lot 801) Clifford Street, Maddington.

    The application includes:

    • A Change of Use of the previously approved ‘Warehouse’ to ‘Industry Noxious’;
    • Construction of a new 41.3m x 33m x 13.1m high bunded tank farm (including four 300kl oil storage tanks and two 65kl separated water tanks) canopy for the unloading of oils and hydrocarbons (liquid wastes) for recycling;
    • Liquid wastes will be received either as bulk delivery (tanker trucks) or via packaged containers;
    • Liquid wastes will be unloaded and stored in the bunded tank farm or bunded warehouse. Liquid wastes will be processed, separated and stored for disposal at an approved off-site landfill facility;
    • Used oil filters will be received and processed at the premises. The process involves crushing the filters with waste oil transferred into sealed containers and the crushed filters aggregated and stored in the bunded warehouse for transfer off-site for recycling.

    The application includes:

    • The demolition of the existing dwelling and associated outbuildings.
    • The construction of a two storey Child Care Premise with roof height of 8.35m
    • The care of up to 68 children and employment of 10 staff members.
    • The Child Care operational hours being from 6.30am to 6.30pm Monday to Friday. Note: staff will have access to the site from 6am to 7.30pm for set up and clean up.
    • Occasional openings may occur between 8am and 5pm on Saturdays (for community open days or marketing purposes).
    • The provision of 17 car parking bays.
    • Colorbond fencing to the perimeter of the site between 1.8m and 2.1m in height and 1.6m high Perspex fencing within the front setback area.

    • Additionally, the single house includes a wall with a major opening on the north-western boundary (adjoining 15 Daly Circle). This major opening (living room) has a wall length of 3.82m and is setback a 1.1m in lieu of the 1.5m required setback.

    The application has been advertised as the lot setbacks do not comply with the ‘Deemed-to-Comply’ requirements of the R-Codes.
